A U.S. court has ordered Guardant Health to pay more than $245.2 million to TwinStrand Biosciences and the University of \u200bWashington after finding that the company infringed patents covering DNA sequencing \u200ctechnology, TwinStrand said on Monday.<\/span><\/p>\n The U.S. District Court for the District of Delaware entered final judgment on August 21, upholding a\u00a02023 jury verdict\u00a0that found Guardant had \u200bwillfully infringed two patents related to TwinStrand\u2019s DNA sequencing technology.<\/p>\n<\/li>\n \u201cWe strongly \u200bdisagree with this decision and will promptly be appealing for its \u2060overturn,\u201d said John Saia, Guardant\u2019s chief legal officer. \u201cWe have full faith in the \u200bstrengths and merits of Guardant\u2019s intellectual property and R&D and are confident we \u200bwill prevail on appeal.\u201d<\/p>\n<\/li>\n The court ordered Guardant to pay a 6% royalty on U.S. sales of 11 products and services found to infringe the patents until they expire in March \u200b2033.<\/p>\n<\/li>\n The judgment includes $83.4 million in original damages, $19.5 million in supplemental damages, $119.4 million in \u200baccrued royalties, and $22.9 million in pre- and post-judgment interest.<\/p>\n<\/li>\n TwinStrand said the products and services covered \u200cby \u2060the ruling accounted for about 90% of Guardant\u2019s revenue during the infringement period.<\/p>\n<\/li>\n The products covered by the ruling include Guardant360 CDx, Guardant Reveal, the Shield cancer test and several other cancer testing and genomics services sold by Guardant.<\/p>\n<\/li>\n \u201cBased on Guardant\u2019s \u200bupdated technology, the \u200bcurrent versions of \u2060Guardant Reveal and Shield are excluded from the order and potential royalties,\u201d the company said in a statement.<\/p>\n<\/li>\n Guardant had sought \u200bto overturn the verdict or obtain a new trial, \u200bbut the \u2060court rejected those efforts, TwinStrand said.<\/p>\n<\/li>\n The judgment also upheld the validity of the patent claims at issue, TwinStrand said.<\/p>\n<\/li>\n TwinStrand\u2019s Duplex Sequencing technology is designed to detect rare genetic \u2060mutations \u200bwith greater accuracy than conventional DNA sequencing methods.<\/p>\n<\/li>\n TwinStrand \u200bsaid its technology, developed at the University of Washington, is used in cancer research, diagnostics and \u200bdrug development.<\/p>\n<\/li>\n<\/div>\n
