Islamabad – Pakistan’s Supreme Court has ruled that there is no appropriate forum available for civilians to appeal against convictions handed down by military courts, directing the government to introduce legislation within 45 days.
In its written judgment, the court stated that the objective is not to nullify the provisions of the Pakistan Army Act, as it already contains basic legal procedures. However, it emphasized that the Act lacks a proper appellate mechanism for civilians.
The court further directed that legislation must ensure individuals convicted by military courts have the right to an independent appeal before the High Courts.
