During the hearing of the 26th Constitutional Amendment case, justices of Pakistan’s Supreme Court made strong observations, emphasizing that the judiciary cannot grant relief “with closed eyes and ears.”
Justice Mohammad Ali Mazhar questioned the arguments presented by lawyers demanding a full court bench, saying:
> “All the lawyers are asking for a full court, but none has explained the proper legal procedure for it.”
Justice Ayesha Malik also weighed in, noting that there is no restriction under Article 191(A) of the Constitution, suggesting that the Supreme Court holds the authority to frame its own rules regarding such matters.
The remarks came as the apex court continued hearings on challenges related to the 26th Amendment, which deals with constitutional and judicial matters that have stirred debate over the scope of judicial powers and parliamentary authority.
