A fresh controversy has erupted in Pakistan’s judicial landscape over the proposed transfer of judges, as reasons have emerged explaining why the Judicial Commission of Pakistan declined to convene a session on the matter.
In his formal response, the Chief Justice stated that transferring judges from the Sindh High Court to the Islamabad High Court would effectively eliminate the province of Sindh’s representation on the federal capital’s bench.
The Chief Justice emphasized that such transfers would leave no judge from Sindh serving on the Islamabad High Court — a development he described as constitutionally and administratively problematic.
Legal experts warn that ignoring the principle of provincial representation in judicial appointments and transfers could undermine the federal character of Pakistan’s judiciary, setting a dangerous precedent for other provinces.
The Judicial Commission has yet to announce a new date for deliberations on the contentious transfers.
