ISLAMABAD: The Supreme Court has imposed a substantial fine on a man for making unsubstantiated allegations of misconduct against his former wife and subjecting her to prolonged litigation following their divorce through khula.
In its ruling, the court observed that dragging a woman into repeated legal proceedings after she has obtained khula constitutes a serious attack on her dignity, autonomy, and fundamental rights.
The court noted that the former husband failed to provide credible evidence to support his allegations, and that the litigation appeared to be aimed at harassing and pressuring the woman rather than pursuing a legitimate legal claim.
According to the judgment, the misuse of legal proceedings as a tool for personal revenge or character assassination is unacceptable and undermines the principles of justice.
The Supreme Court emphasized that women must be able to exercise their legal right to seek khula without fear of retaliation, adding that the judiciary has a responsibility to discourage abusive litigation through appropriate legal sanctions.
The court consequently imposed a significant financial penalty on the petitioner and reaffirmed that the judicial system cannot be used to settle personal scores.
