During a mistrial and hung jury in September, prosecutors in Massachusetts plan to retry Lindsay Clancy.

Lindsay Clancy is accused of killing her three children, Cora, 5, Dawson, 3, and Callan, 8 months, at their Duxbury home.

The prosecution has filed for a second trial, but some sorely needed legal rulings must first be made before even getting the process up and running.

The core defense Kevin Reddington, Clancy’s lawyer, has maintained that he is not guilty by reason of mental defect because of the postpartum psychosis and excessive medication he was under.

The prosecutors did not say whether the retrial would lead to any specific charge of murder. In the opinion of the legal prosecutors, Clancy was fully aware of the fact that she was doing something wrong, but the killings had been planned.

In a recent appearance in front of the Plymouth Superior Court, Judge William Sullivan indicated they were leaning towards March to do a trial. They set some more scheduling dates in mid-November.

Motions Pending: “Effectively stayed” while the case awaits “disposition” on motions including proposed gag order by the prosecutors for the prosecutors and other public statements, and motions by the defense regarding where the case is headed.
